Lease annulment agreement
Michael Solomonides has declared that he wishes to leave the lease associated with 286 John St, Rochester, NY 14623. In order to facilitate Michael's wishes, this document is being written.
First: Michael shall assume all financial responsibilities for his wishes until that time in which a suitable house mate can be found to assume said financial responsibilities or until 3/1/08. These include: rent, utilities, and security deposit. If after 3/1/08 Michael has not vacated the premises, he shall still be responsible for rent, utilities and other financial responsibilities for that month.
Second: Once a house mate is found, that individual will take on the financial responsibilities left behind by Michael. This includes rent and utilities for the remainder of that month and remaining security deposit. Since at the time of payment Michael only submitted $320, that is the maximum amount of returned security deposit. The current house mates will do what they can to help facilitate this exchange, however they will not be held responsible for any losses.
Third: Michael shall assume all financial implications associated with the light fixture in the laundry room and the kitchen floor. He is additionally responsible for any damages to the room he occupied. Michael is responsible for making arrangements with Don Hamblin (Landlord) for payment. If Michael fails to do so, he forfeits ALL of his security deposit. Additionally, if any of the damages exceed the amount of Michael's original security deposit, he will assume full financial responsibility for the remaining costs.
Fourth: This does not constitute an eviction by any means. This means that by signing this document, Michael will vacate the premises before the date of 3/1/08. Failure by Michael to do so makes this document null and void.
Fifth: Once Michael has vacated the premises, ALL key copies to the house and the room he occupied must be returned either to Don Hamblin, or to the remaining house mates.
Sixth: If any of this document is changed in part or in full, Melody and Chris both refuse to sign any and all documents submitted regarding Michael's release from the lease.
